santa rosa grieves the death of a 13-year-old shot and killed while holding a replica gun good morning. live pictures from union city where fire crews are on the scene of a warehouse fire. this started about two hours ago. it's pretty well contained. there were some scary moments for people inside the at -- the area. steve, i couldn't wait to turn the heater on. >> yes, it's cold. it will be sunny. mostly clear skies. a lot of 30s popping up.

extra time or leave earlier than usual. at the bay bridge toll plaza, you can see that the backup is quite extensive. the metering lights are on. give yourself extra time into san francisco. more than usual because of this problem, let's show you the eastshore freeway which has been extremely sluggish all the way from the macarthur maze right here in the berkeley emeryville area, on up through hercules. definitely looking at some massive, massive delays this morning. let's head back to the desk. >> thank you, tara. a warehouse for baked goods caught fire in union city. this is a live picture of the facility. it's on western avenue near pacific street. it's not far from alvarado niles road. the fire started about 5:15 this morning. it went to two alarms before it was put out by alameda county fire crew. several people were in the building at the time of the fire. but they were able to escape safely. no word yet on a cause.

highway 121 in sonoma county has reopened following a deadly crash that injured three people including a 5-year-old child. the accident happened around 7:00 last night on meadowlark lane near the sonoma raceway. christien kafton is live with more. >> reporter: good morning. we also have new information about a new countywide effort to crack down on drunk driving incidents. but let's talk about this accident that happened here on highway 121. this accident killing one person, injuring three others. one of those injured was a 5- year-old girl. we're hearing she had major injuries. investigators say 25-year-old was driving a 1997 jaguar south along highway 121. witnesses say he crossed the center line to pass some other cars and that's when the collision occurred. the jaguar crossed into oncoming traffic and a toyota coming in the opposite direction hit that jaguar head

on. a 21-year-old was dilled in the accident -- killed in the accident. the 26-year-old driveert of the toyota and a 5-year-old girl both injured. that 5-year-old flown to children's hospital in oakland with what are being called major injuries. the man was taken to the hospital. no word on how serious his injuries were. chp investigators tell ktvu that they are looking to see if the man was intoxicated at the time of the accident. >> the driver of the jaguar is being investigated for potentially driving under the influence of drugs or alcohol at this time. >> reporter: various sonoma county law enforcement agencies received a series of grants to step up impaired driving enforcement for drunk driving. the bulk will go to the anti- drunk driving campaign. this come in time for

halloween. an officer said halloween is definitely ranking up there as one of the major party nights. and that with trick or treaters out can prove to be a deadly combination. we're looking to see if there's criminal history on the part of the driver of the jaguar that was in that fatal accident last night. if we found out more information, we'll certainly bring that to you. for now we're live along highway 121 in sonoma county, back to you. 7:06. police in the south bay still searching for four suspects in a nightclub shooting over the weekend. we now have surveillance video of the suspects they are looking for. ktvu's janine de la vega live in campbell with the details including this is not the first time there's been violence at this particular nightclub. janine? >> reporter: dave, back in 2009, four people were stabbed here by one suspect but police say in this latest incident it was a security guard that was shot here in the parking lot of

the spot nightclub in downtown campbell. surveillance video shows all four of the suspects. here's the video. you can see a man with dark hair and a goatee enter and look around the club. he's in the center of the screen and then a second suspect, a man with dark hair and a boetee, he walks in, looks down at his wallet and starts talking to the suspect. the third man walks in with camouflage pants. he has ka toos on both arms and -- tattoos on both of his arms. the next suspect, an asian female. a male bouncer was shot by one of the suspects when he asked them to turn down the loud music coming from the parking lot. we spoke to a security guard unrelated to the club who told us his thoughts on the spot. >> i remember it being closed down a while back. i think that was due to a stabbing previously. it was a little bit of a reputation. but other than that, all of the

other bars around this area are fine. >> the victim is 33 years old. he's recovering from a single gunshot wound. the suspects in this case fled in two cars. one is a dark-colored 1990s chevy camaro, possibly with dealer plates. the second car is a later model four-door sedan that may be light in color. they were last heading east on orchard shi drive. cam bem police would like to hear from you -- campbell police would like to hear from you if you recognize any of the suspects. the club is located in the heart of downtown campbell. right in the shadows of the historic campbell water tower. this is considered a safe area with a lot of shops and restaurants. it's very much a concern for people who live here. janine de la vega, ktvu channel 2 news. there is a new audit out showing california's justice department and the courts have

not identified thousands of mentally ill people who should not be allowed to have a gun. the audit found that 34 58 superior courts did not file more than 2,000 prohibited person reports to the mental health unit between 2010 and 2012. the audit called on the legislature to require all mental health-related prohibited person reports to be filed within 24 hours. 7:09. why did it take so long and cost so much to build the new bay bridge. the contra costa times reports a state senate committee is launching an investigation to find out. it took 11 years to build the bridge at a cost of $6.4 billion. engineers originally estimated construction would cost $1.4 billion and would only take four years. the state senate plans to use its subpoena powers if necessary to complete the investigation. we're now learning about a second mystery barge with

reported ties to google. there's been a lot of talk about the mysterious structure being built on a barge at treasure island in the san francisco bay. and there are now reports google is building a similar floating structure in portland, maine. that's also shrouded a mystery. google would not comment when asked about the projects. but both structures are believed to be a floating data center for google. oakland police made an arrest after a shooting at a motel last night. police were at the value inn on west macarthur boulevard about 7:15 last night. a woman had been shot in the face. we are ally told she's in serious but stable condition. we have no details about the person arrested. police say the suspect is an arrest. oakland police also looking for the car and the suspects involved in a carjacking. police say about 8:45 last night. suspects forced their way into a woman's car at 46th and

adeline. they forced her to drive to an atm and take out money. then she was dropped off at the corner of high street and international boulevard. she was driving a 1999 ford winstar. the license plate, 4 vou 399. now, if you have any information call oakland police. you can add facebook to the growing list of silicon valley companies reportedly interested in buying the struggling smart maker blackberry. facebook executives met with blackberry in california to discuss a possible bid. other parties reportedly interested in acquiring blackberry include cisco, google and former apple's ceo, john skullly. happening today -- the golden state warriors getting ready to play basketball tonight for the new season. the warriors will host their long-time rivals, the los angeles lakers in oakland tonight. this is video of them playing

happening right now -- health and human services secretary kathleen sebelius is testifying before congress about all of the problems with the government's healthcare insurance website, and she's already apologized for the rocky rollout of healthcare caught govern. in fact -- healthcare.gov. she's facing pretty tough questions at that hearing. ktvu's kyla campbell is joining us live with some of the heated comments already this morning. kyla? >> reporter: well, dave, one house lawmaker asked kathleen sebelius who was in charge of the website rollout and she pointed to another department, cms. but when that lawmaker followed up, kathleen sebelius said she's the one who needs to be helds responsible for the

website problems. we're taking a live look right now at the house energy and commerce hearing, secretary kathleen sebelius called the online experience miserably frustrating. >> i'm as frustrated and angry as anyone with the flawed launch of healthcare.gov. let me say directly to these americans, you deserve better. i apologize. >> reporter: lawmakers want to know when kathleen sebelius knew healthcare.gov was in trouble and if she knew before the launch, why the administration told congress and americans that everything was ready to go. the top democrat on the committee said these website woes will be forgotten because the affordable care act is working. a california republican chimed in chastising. >> you love what's wrong with the website. and you detest what's working in the affordable care act. and i think that that is on full display here. >> reporter: the focus of the

hearing is shifting to people losing coverage after president obama and the administration promised people if they liked their plans, they could keep them. this is what mike thompson from the bay area talks about. more at 8:15. back to you. >> thank you. more trouble for the healthcare.gov website last night. maintenance kept customers from submitting applications. verizon one of the contractors working on the website says government officials asked government officials to provide them extra computing and storage facility. the website appears to be back up and running this morning. later on today, president obama flies to boston and calling for patience with the rollout of the affordable care act. he will talk about the problems massachusetts had when it launched its own insurance reform which is now very popular. the government released how

much social security will increase next year. the annual cost of living adjustment is 1.5%. this makes it one of the smallest increases since automatic adjustments were adopted back in 1975. the cost of living announcement was scheduled for two weeks ago but it was delayed by the government shutdown. there's new information about last year's ital yuge cruise ship -- italian cruise ship disaster. a dancer is now testifying at the trial of the captain of the ship which sank off the coast of italy. the dancer says she was the captain's lover and admits she was traveling for free. the dancer also says she was with the captain when the cruise ship ran aground. the captain faces multiple charges of manslaughter and abandoning the ship. he faces up to 20 years in prison if convicted. 7:18. police have now identified the victim who died in the shooting that injured seven other people

in vallejo. investigators say 19-year-old hoe hey rodriguez of rich -- jose rodriguez of richmond was shot and killed in that drive- by shooting on princeton avenue late saturday night. four other victims are still in the hospital. they were last reported in critical condition. police haven't determined a motive for the shooting and they say they are still looking for suspects. in other news this morning, researchers say there's a worldwide shortage of wine. right now, there are a million wine producers around the world turning out 2.8 billion cases every year. however, according to a morgan stanley report, that's still not enough to meet demand. production fell by more than 5% last year to the lowest level since the 1960s. they say it's primarily due to bad weather in france and in argentina. the u.s., by the way, consumes 12% of the wine in the world but only produces 8%, tori. >> really? have to bring in another 4% of

our wine. >> uh-huh. want to check in with tara and get an update on a sig- alert in fairfield. >> we have lanes on 880 near air base parkway. we have three lanes in the eastbound direction and two lanes in the westbound direction. that's right here is where we're talking about. they are still shut down. this is due to an earlier car fire. there are also some fender- benders in the area making traffic worse. traffic is backed up from vacaville to lagoon valley road, from here to vacaville. it's about a 41-minute delay. so definitely some headaches here in the east bay this morning if you are headed to sacramento, you might want to be aware of it. let's take a look at the eastshore freeway. this has been an absolute nightmare. it happened a long time ago but they had one lane blocked and it just really exasperated the situation. you with looking at delays here. at the bay bridge toll plaza, metering lights are on.

slug irk. 7:32. let's head to the desk. sham on you! shame on you! >> hundreds of angry protesters mare offed to the sonoma county sheriff's office protesting the deadly shooting of 13-year-old andy lopez. later today, another march and rally is planned in santa rosa. in the meantime we're getting new information now about the moment that andy lopez was shot. ktvu's pam cook is in our newsroom now with that story. >> we're hearing from a second deputy who was at the scene about the moments during that fatal shooting of 13-year-old andy lopez. now, investigators say the teenager was already more tally wounded by the time a -- mortally wounded by the time he got in position. while the investigation continues, so do the protests and reaction from the

community. hundreds of people attended the teenager's funner -- funeral last night. the investigation shows the 13- year-old was holding a bb gun that resembles an ak-47 assault weapon. county leaders say this has led to growing tension between law enforcement officers and the community and county leaders say there needs to be better communication between police and the people. >> that's part of the discussion we're gonna have. what dialogue can owe create to ensure -- can we create to ensure we have that? because it doesn't exist in the community. >> this is a national story and is raising the debate on when police officers should use deadly force. in our next hour of "mornings on 2," we're gonna hear from a weapons expert and formal police chief in san francisco about this kind of case. reporting live in the newsroom, pam cook, ktvu channel 2 news. 7:34. a ktvu investigation shows every year more than a million

people don't pay the tolls that go across bay area bridges. one way they do it, they use temporary cardboard license plates. these blank dealer plates are stolen off newly-purchased cars and can't be traced. every month, about 100,000 cars go across the bridges with no license plates. that's millions of dollars in lost revenue. >> those folks that are using the toll bridges and not paying for that crossing put a greater onus on these who do pay our tolls. >> the transportation commission wants a change in the state law. they want to require all cars to have license plates before they can leave a car lot. a proposal being considered will require car dealers to print and install temporary paper plates with numbers on them. that would then be entered in the dmv's database. 7:35. the search for answers continues in the case of lynne spalding. she was the woman found dead in

the stairwell earlier this month at san francisco general hospital. ktvu channel 2 reporter, brian flores has more on the missing witness police are hoping to find. >> reporter: good morning to you, tori. i just got an e-mail response from the san francisco general hospital spokesperson who says, yes, they are continuing to search for the key witness who may have more information into the death of lynne spalding and that "we hope it results in more answers to what happens to her which we all want to learn." police with san francisco and ucsf are asking for the public's help to find this witness. he may have been a hospital employee. he's described as asian, approximately 30 to 40 years old, 5'8", with a medium build. at the time, he may have been wearing a blue shirt and possibly a tie. now, according to an information bulletin sent out yesterday, this man was wearing a hospital badge at the time and was admitted on the fifth

floor stairwell on october 4th. this goes on to say this man saw a woman lying on the stairwell. he told a senior staff member who then called the san francisco sheriff's department to investigate. when they followed up, however, nobody was found. when they tried to follow up with the witness again, he couldn't be found either. it took four more days for spaulding's body to be recovered. this morning, police are looking to talk with this man to gather more information. if you know where he is, you are asked to call the sheriff's department. sheriffs have ruled out foul play but they are trying to investigate more in the death of lynne spalding. coming up, you will hear more from the hospital on their response on trying to find this key witness. we're live in san francisco, brian flores, ktvu channel 2 news. now, according to the san francisco chronicle, the sheriff's deputies assigned to san francisco general earned some of the highest amounts of overtime in the city. sheriff deputies say a quarter

of the 28 deputies and institutional officers assigned on a 24-hour basis at the hospital are on overtime. in some cases, overtime is adding about 80,000 to their annual salary. the san jose city council is considering two proposals to keep new officers from leaving the police department. one plan would require officers to pay back a share of training costs if they leave within five years. a second plan calls for the police academy to charge tuition and offer recruits a zero interest loan. the city would pay back the loans of recruits who stay with the department. >> the truth is, we need more officers. no matter how hard they work, there is no surbs stut for having more -- substitute for having more officers on the street. >> counsel members say it can

cost $170,000 to recruit and train each new officer. officials at the 49ers new stadium in santa clara want to hire current and retirted law enforcement officers and pay them for more $50 an hour to work part time. 120 people will be hired for the stadium security team at the 49ers home games, concerts and super bowl l. they will be working with santa clara police officers who will be assigned to major events at levi stadium. again, $50 an hour. those who are hired. you have to first go through a background checks. an arraignment is scheduled today for a woman accused of killing two people in a menlo park drunk driving crash after it was postponed twice. the san mateo district attorney says 53-year-old marjorie reitzell had a blood alcohol level well over the legal limit at the time of the accident. she's in the hospital. she has not yet been cleared to appear in court. police say she hit kamal and

balbir singh from behind as they were walking their dog last thursday. she's facing charges of gross vehicular manslaughter as well as drunk driving. she's being held on $2 million bail. police are investigating a triple shooting that happened in east palo alto. police say they found three people who had been shot about 8:00 last night on myrtle street. they were rushed to the hospital. we're told they are in stable condition. if you have any information about what happened out there, call east palo alto police. 20 minutes before 8 clg. happening today -- 8:00. happening today, some teachers and students at oakland technical high school are planning to protest a visit to the school this morning by janetnal napolitano. the protesters say they are calling for her to be removed as president from the system because of the large number of undocumented immigrants reported as she was homeland secretary. tonight she will outline the

vision for the uc system in what's being billed as her first major public address. she will speak at 6:00 at a common wecht event at the mark -- common wecht event at the mark -- commonwealth hotel. two caterpillars were returned to a construction company last night after someone stole the company from the site last week on marsh creek road. those missing excavators cost more than $100,000. the chp is expected to release more information on how they were found later this morning. hour time is 7:31. later today, yelp will rut the -- cut the kibben on their -- ribbon on their new headquarters. nancy pelosi and ed lee will be

citizens is suing the state of california. the foundation aiding the elderly accuses state regulators of endangering nursing home patients by taking month not years to investigate complaints against care facilities. the group says the nursing home industry is not afraid of regulators because they are "lax in their responsibilities." the state says it cannot comment on any pending litigation. 7:48. delegation from the european union will meet with white house officials today to discuss the recent revelations that the u.s. spied on european leaders. the urn parliament's civil -- european parliament civil department has been there since monday and has met with the state department and various intelligence agencies. president obama has ordered a review of intelligence- gathering programs following the reports of data collection and eavesdropping on allies. lawmakers are meeting on

time detaching. >> if you have any information about james mcintosh or michael reed, call police. let's bring tara back. good news about fairfield. >> a little bit. that earlier sig-alert canceled all westbound lanes near air base parkway are now open. this is a look at newschopper2. look at the burn marks. they are all over the roadway from this trailer, this truck that exploded earlier this morning. you can see that they do have lanes blocked still so traffic still a little bit slow going through this area. there's also another accident in the area, a fender-bender nearby. still two eastbound lanes closed and apparently caltrans is gonna have to scrape some of the burn debris from the roadway. if we tilt up, you can see the backup, you know, it's just very, very heavily congested. so definitely give your some extra time if you need to get through the vacaville/fairfield area this morning. look at that on both sides.

deputy said a phone charger saved her life. a charger deflected a shootout yesterday in inglewood. two other deputies were hurt in the gun battle. >> she had the charging wire that you would charge a cell phone with. the tab that inserts into the phone. the bullet struck that tab. >> shots were fired during a traffic stop and they returned fire killing the suspect. this is the second story like this. if you missed our story yesterday morning, a gas station clerk in florida stays his cell phone saved his life after he was shot in the chest during a robbery monday morning. the clerk had no idea he was shot until he felt a -- a pain in his chest. when police looked at his phone, they found a bullet lodged inside. the clerk had some bruising but is expected to fully recover. 7:57. it took 1 is years to build -- it took 11 years to build the new bridge. the investigation happening into the delays and the cost overruns on the new bridge.

town. san jose, 44. fairfield at 41. san francisco now officially i saw 51. but i saw some upper 40s. 51. we'll go for a high of 61. 59, 60 and today 69. 22 up in tahoe. 19 in truckee. ukiah, 289 degrees. you can see the -- 29 degrees. you can see the high clouds washing away. some patchy fog, thick for a while. it's cold out there. there's no breeze. highs today, upper 50s, low 60s and a few mid-60s. we've had quite a nightmare in the vacaville area. if we take a live look at newschopper2. we can see that the -- they are starting to clear this incident right now. this was a pickup truck that had a trailer on it and it caught fire. and you can see all of the burn marks there on the roadway as well as on the center divider. there's damage there. this happened in the eastbound lanes of 80, interstate 80 and

you can see it's very slow going and there are still two lanes blocked right at that section. but for the most part, all of the eastbound lanes are open and you can see the westbound lanes are now open. those had been closed down completely earlier this morning. we a big sig-alert issued. still some delays here. but it looks like the traffic is bunching up near the accident. that's some good news for folks near the air base parkway. that's where the earlier accident happened. let's take a live look at highway 4 through the baypoint/pittsburg area. it's very slow going in the westbound direction, we had a fender-bender here. don't know if that led to these problems right now. but it's not been this slow this morning. so definitely give yourself extra time. at the bay bridge toll plaza, gridlock, give yourself an extra 20, 25 minutes. eastshore freeway, finally starting to pick up from the earlier accident. we to have delays into the city. 8:02. let's head to the desk. >> thank you, tara.

highway 121 has reopened following a dui deadly crash that also injured three people including a 5-year-old child. the accident happened around 7:00 last night on meadow park lane near the sonoma raceway. christien kafton is live to explain how police are cracking down on dui cracks, especially around halloween. >> reporter: absolutely. we've moved in the last half- hour to give you a better sense on exactly how this accident unfolded. from what we understand, the jaguar was moving southbound coming through this area when he crossed the stentor line and collided -- center line and collided with another car. this whole accident happening just after 7:00. the accident killed one man, left three others injured, one of them -- them a 5-year-old girl. they say the man behind the jaguar crossed the center line to pass other cars and that's when the collision happened. the jaguar crashed into oncoming traffic.

a toyota hit the jaguar head- on. a 26-year-old man in the jaguar was killed in the impact. still no word on his identity. the 26-year-old man driving the toyota and his 5-year-old child also in the toyota both seriously injured. that 5-year-old child flown to children's hospital in oakland with what are being called major injuries. he was also taken to an area hospital with serious injuries as well. the chp investigators suspect this may have been a case of drunk driving. drugs and alcohol are suspected to be involved in this traffic collision and it is again too early to release any other information but we are investigating that as being involved. >> sonoma county law enforcement recently received a series of grants to step up imbared driving enforcement. the bulk. family is gonna go to petaluma police to avoid the anti-drunk driving campaign. we just got off the phone about 20 minutes ago at california highway -- with the california

highway patrol. they said that halloween has turned into a party holiday and kids are out trick or treating. certainly one of the issues to think about as you take your children out trick or treating tomorrow night. we're live along highway 121, back to you. >> thank you. new this morning, we're learning more about a warehouse fire in union -- union city. it started at the sterling foods plant. firefighters credit the sprinkler system for helping contain the fire. no word on what caused the fire. but flames spread to heavy machinery and piles of storage. >> the sprinkler system was a great assistance. large building, heavy smoke, we're always concerned about our people getting lost inside. >> there were about 25 employees inside the building at the time of the fire. but they were all able to make

it out safely. 8:05. new surveillance video from campbell police. it may lead to four suspects in a weekend shooting at a nightclub where one man was wounded. janine de la vega here live now from campbell and you just talked to the police. what did they say? >> reporter: well, they haven't received any tips yet this morning, but they are optimistic because this 52- second video shows some distinctive tattoos of the men. now, someone -- they are hoping someone will recognize them. all four were inside the spot nightclub four less than an hour. they ordered drinks and then they went outside. now, here's the video. you see a man with dark hair and a goatee enter and look around the club. here's in the center of the screen. then the second suspect, a man who also has dark hair and a goatee walks and looks down and starts to talk to the first suspect. police believe the third suspect is the shooter. he's the man wearing camouflage

pants and tattoos covering both of -- both of his arms. the fourth suspect is the asian female next to him. police say on saturday morning, just before 2:00, a male bouncer asked the group of four to turn down loud music coming from their car in the parking lot. police say it then is clatted to pushing and shoving. that's when one of the men  opened fire. >> we've been analyzing the video and looking at the specific tattoos, especially on the left forearm and the right hand. and we're optimistic that we'll be able to identify the tattoos and the persons associated with those. >> reporter: do you think they are local? >> at this point, we don't know. >> reporter: the victim is 33 years old and is recovering from a single gunshot wound to the abdomen. the suspects fled in two cars. one a dark colored 1990s chevy camaro, the other is a four- door sedan possibly light in color. they were last seen heading east on orchard drive.

campbell police would like to hear from you if you recognize any of the suspects. the club is located in downtown campbell. it's very close to a lot of shops and restaurants. campbell police says -- you know, they consider this a very safe area. they believe that even though there was a stabbing here back in 2009, they still say this shooting is an isolated incident. reporting live from campbell, janine de la vega, ktvu channel 2 news. 8:08. there's a new audit showing the california's justice department and the courts have not identified thousands of mentally ill people who should not be allowed to own a gun. the audit found that 34 out of 58 superior courts didn't file more than 2,000 prohibited person reports to the justice department's mental health unit between 2010 and 2012. the audit says the legislature should require all mental health related prohibited person reports be filed within 24 hours.

8:08. why did it take so long and cause so much to build the new bay bridge. the contra costa times reports a shat senate committee is launching an investigation is -- to find out. it took 11 years to build the bridge. it cost $6.4 billion. a huge jump over the expected $1.4 billion price tag. the state senate plans to use the power -- the subpoena powers if necessary to complete the investigation there's been a lot of talk about a mysterious structure being built on a barge at treasure island. there are new reports that google is building a similar floating structure in portland, maine that's also shoulded a mystery -- shrouded a mystery. google will not comment. both structures are believed to be a floating data center for

google. oakland police made an arrest after a shooting last night at a motel. police rushed to the value inn on west macarthur boulevard around 7:15 last night. a woman was shot in the face. reportedry she's in serious but stable condition. police will only say the suspect is an adult. oakland police searching for a car and the suspects involved in a carjacking. police say around 8:45 last night, the suspects forced their way into a woman's car at 46th and adeline. they forced her to drive to an atm and withdraw money and she was dropped off at high street and international boulevard. she was driving a 1999 ford winstar. the license plate, 4 vou 399. if you have any information, call police. 8:10. police in san jose are searching for the thieves who

stole $70,000 worth of laptops and ipads from an elementary school. officials at river glen elementary discovered the break- in on monday. 31 laptops and 31 ipads were taken. teachers say the loss -- loss of the equipment will make it hard to give standardized tests supposed to be done on computers. engineer chris shepherd and crter larry daniels were working on the tracks on october 189ge when they were hit and killed by a train. lawmakers say a policy that makes track workers responsibility for their own safety may have contributed to the accident. b.a.r.t. discontinued that policy shortly after the workers were killed. an assembly committee plans to hold a hearing on november 7th in san francisco. cheating at the toll plazas here in the bay area. not paying anything.

two children were found last night. police think the shooter is among those victims. the gunman called 911 before the shootings to say he was thinking about hurting himself. back at home, a fund has been set up to help pay funeral expenses for the victims of a horrifying crash in lodi last week. five members of one family were killed in this multicar crash right near lodi middle school. among them, three children and a pregnant woman. the mexican consulate in sacramento has set up a fund to help transport their poddies back to mex -- bodies back to mexico. the money will help the one child who survived the crash also. police are looking for thieves who stole 40,000 feet of copper wire from lake merritt the's light display. work has begun near ferry land to repair the work and repairs are expected to cost at least

8:18. speaking of trick or treating, tara has traffic. the east bay commute has been goulish. >> that's very appropriate. it's showing signs of improvement. we had both sides of interstate 80 shut down earlier. but as newschopper2 is gonna show us here, the roadway is clear. this is 80 eastbound near air base parkway and crews are sort of still hanging out in that section where the accident happened because there was damage to the roadway and the concrete wall. so they have to scrape some of those char marks off. otherwise traffic is really starting to flow again. here's some video from adrian vargas. this was the pickup that had a trailer on it. it exploded in flames, scripped across the -- skipped across the concrete barrier and that's why the entire freeway had to be shut down. the been toll plaza, bumper to bumper back to the maze. metering lights are on.

tonight, san francisco police chief greg suhr holdings a town hall meeting about a -- hoegeds a town hall meeting about a weekend shooting -- hoegeds a town hall -- holds a town hall meeting about a weekend shooting. police were forced to open fire after he beat a man. the last report, the suspect is in critical condition. the meeting starts at 6:15 at marina middle school on fillmore street. in marin county, jury deliberations resume in the trial of max wade. he's accused of attempted murder and stealing a sports car belonging to celebrity chef. he's 19 years old. he's being prosecuted as an

adult. even though he was arrest when he was only 17. he's charged with shooting at a teenaged girl and her boyfriend last year. prosecutors also say he stole a $200,000 car belonging to tv chef guy fee fee et -- guy fieri. a plan that would limit dock access in san francisco is not being supported -- dog access in san francisco is not being supported opposing the golden gate area's plan to limit dog access to parks. scott wiener wants the plan modified for rerk ration areas like chrissy -- rerk -- recreation areas like crissy field and ocean beach. uber added an option for kitten delivery. now, people can use the uber app and order a kitten for a 15-

benders and over on the peninsula, we do have slow going traffic here on 101. so be careful there over in hayward, there's a pair of accidents as well and heavy traffic on 880 southbound. let's take a look at the eastshore freeway where we had the earlier problems this morning. it looks like things are still sluggish. everything has picked up. that's good news as you make your way to the maze. at the golden gate bridge, you can see that things are flowing nicely in san francisco. let's head back to the desk. shame on you! shame on you! >> hundreds of angry protesters marched yesterday to the sonoma county sheriff's office protesting the deadly shooting of 13-year-old andy lopez. and later on today, another march and another rally are planned in santa rosa. ktvu's pam cook is in our newsroom now to tell us about the tensions in that community, pam, and also the concerns of police officers. >> yeah, the shooting is dive

individualing the community of -- dividing the community. angry protesters on one side, concerned police officers on the other. at the heart of the controversy was the shooting justified? now, at the time he was fatally shot by a deputy, 13-year-old andy lopez was holding a bb that officers say lookses just like an ak -- looks just like an ak-47 assault weapon. we spoke to san francisco's police chief about the case. he says officers often have little time to display a toy replica from the real thing. >> police officers have a right to defend themselves. they have a responsibility to defend themselves. in a split second, the officer has an opportunity to decide whether it's real or not. >> he says police officers routinely go through extensive training on when and when not to use deadly force.

but that training can't prepare them for every possible scenario. now, as we've seen, hundreds of people when to andy lopez's funeral last night. thousands have shown up for the protests of the fatal shooting that continue. county leaders calling for better communication between police and the community to help ease the tension. reporting live in the newsroom, pam cook, ktvu channel 2 news. a ktvu investigation shows every year more than a million people don't pay the tolls at bay area bridges. one way they do it, they use temporary cardboard license plates. these blank dealer plates are stolen off newly-purchased cars and cannot be traced. every month about a hundred thousand cars go over the bridges with no license plates. that's millions of dollars in lost revenues. >> when a plate for whatever reason can't be read and in this case because the plate isn't there, we peg those

losses at about $4 million a year. >> now, the transportation commission wants to change state law to require all cars to have license plates before they can even leave a car lot. a proposal being considered would require car dealers to print and install temporary paper plates with numbers on them. they can then be entered into the dmv database. more questions surrounding the death of 57-year-old lynne spalding. police are now looking for a witness who may have been the first person to see her on the stairwell of san francisco general hospital. ktvu's brian flores is there now to let you know who the police are looking for. good morning, brian. >> reporter: good morning, tori. investigators having a tough time trying to identify and even find this key witness but i did get an e-mail from a san francisco general hospital spokesperson who says yes, they are continuing to search for the key witness and that we hope that it results in more answers to what happened to her which we all want to learn.

now, again, police with san francisco and ucsf are asking for the public's help in finding the witness. according to police, he may have been a hospital employee. he's described as an asian man approximately 30 to 40 years old. 5'8" with a medium build. at the time he may have been wearing a blue shirt and possibly a tie. according to an information bulletin sent out yesterday, this man was wearing a hospital badge at the time and was@mitted on the -- admitted on the filth floor emergency stairwell around 7:30 a.m. on the 4th of october. it says a man saw a woman lying on the stairwell. he told a senior staff member who called the sheriff's department to investigate. when they followed up, arnt payly nobody was -- apparently nobody was found and when they called the witness again, he couldn't be found. it took now more bodies for the body -- days for the body to be recovered on the 8th.

>> we appreciate the expanded efforts to find this important information about what may have happened to lynne spalding. we hope it will result in more answers to this tragedy. >> reporter: as we take it back out here live, police looking to talk with this man again to gather more information. san francisco general says they will not be holding a press conference today in regard to this. but they say that this is a police matter. but they will continue to be open with the investigation this morning. we're live here in san bernardino, brian flores -- san francisco, brian flores, ktvu channel 2 news. the san jose city council is considering two proposals to keep new officers from leaving the department. one plan would require officers to pay back a share of training costs if they leave within five years. a second plan calls for the police academy to charge tuition and offer recruits a zero interest loan. the city would pay back the loans of recruits who stay with

the department. the truth is, we need more officers and no matter how hard they work, there is no subs suit for having more officers on the streets. >> police departments in oakland, hayward and los angeles already have repayment requirements. council members say it can cost $170,000 to recruit and train each new officer. 8:37. an arraignment is planned today for a woman accused of killing two people in a menlo park drunk driving accident after the arraignment was postponed twice. the san mateo district attorney says 53-year-old marjorie reitzell had a blood alcohol level well over the legal limit at the aisle time of the accident. she's in the. she's not been cleared to appear in court. police say her car hit kamal and balbir singh from behind as they were walking their dog last thursday. reitzell faces charges of gross vehicular manslaughter as well as drunk driving. she's being held on $2 million

bail. a 5-year-old boy is in the hospital after falling off a roof in san ralph fell. this -- san rafael. it happened at an apartment building on lincoln avenue. the marin independent independent journal says the boy was playing on the balcony when he climbed on the roof and fell 15 feet. he has head injuries -- he was head injuries. authorities have found two huge pieces of construction equipment recently stolen in the east bay. ktvu news received this photo shortly after the two yellow caterpillar excavators were found in the city of byron. they were returned to the construction company last night. someone stole the equipment from contra costa county last week. the missing excavators cost more than a hundred thousand dollars. the chp is expected to release more information on how they were found later this morningge. 8:389.

was already mortally bound wounded by -- wowrnded by the same -- wounded by the time a second deputy got out of the car. highway 121 in sonoma county, back open after last night's deadly crash injured three people including a 5-year- old child. christien kafton has been out there since early this morning. you are finding out what may have led to the crash. >> reporter: we've been out here since 4:30. now we can give you a better chance. investigators tell us that the jaguar was heading southbound like these cars coming toward us right now on highway 121. the vehicle was coming this way south, crossed over the center lane in this air you and collided with another -- in this area and collided with another vehicle. that car crash killed one man and left three others injured. one of them a 5-year-old girl.

witnesses say that 25-year-old in the jaguar was behind the wheel and crossed the center line to pass another car. that's when the collision happened. the jaguar crashed into oncoming traffic and a toyota coming in the opposite direction hit the jaguar head on. a 26-year-old man in the vehicle was killed. still no word on his identity. the 26-year-old man driving the toyota and his 5-year-old child also in that toyota were both serious injured. that 5-year-old children was flown to children's hospital in oakland with what are being called major injuries. the chp investigators suspect this may have been a case of drunk driving. now, sonoma county law enforcement recently received a grant to step up impaired driving. the bulk of the money go to for the anti-drunk driving campaign here. i had a chance to speak with the highway patrol.

they reiterate that ha lone we is turning into a -- halloween is turning into more of a party holiday. and there's trick or treaters and that can be especially dangerous. so many families will be out walking the streets tomorrow. we'll continue to monitor the situation and bring you updates throughout the day as we learn more about the investigation. christien kafton, ktvu channel 2 news. >> thank you. 8:47. there are new details now about the owners of an assisted living home in castro valley that was shut down by the state due to charges of unsafe and unsanitary conditions. the owners, the manual family, has a fair facility in modesto. the california department of social services has brought in independent investigators to examine that nursing home for any mistreatment of patients. >> they're bringing in outside contractors to assess the residents and to determine if there's adequate levels of care

and supervision being provided. >> if the state finds violations, it can file a temporary suspension order at any time against the modesto facility. this afternoon, the alameda county sheriff's office and fire department will hold a news conference to discuss their findings into the fair facility in castro valley. the state is reviewing how 19 patients were abandoned for more than two weeks. the state blames the facility for not transferring all of its patients after the nursing home was ordered to close. 8:49. a delegation from the european union meets today with white house officials about the recent reports the u.s. spied on european leaders. delegation has been in washington since monday. they've already met with state department officials and intelligence agencies. now, president obama ordered an investigation of intelligence- gathering programs after the reports of spying on allies by the national security agency. also new this morning, the government just told us how

much social security payments will go up next year. the annual cost of living adjustment is 1.5%. that's -- 1.5%. that's one of the smallest increases since automatic adjustments were adopted in 1975. the cost of living announcement was scheduled for two weeks ago but it was delayed by the government shutdown. 8:489. san francisco's old mint is being used as a haunted house. the 140-year-old landmark was rented out for the week and turned into a paid halloween attraction. complete with a room gulf ghosts and goblins. the mint is managed by the nonprofit museum and historic society. they hope to turn it into a city museum one day but until then, they went it out in an effort to pay the bills. >> all right, tori. 8:50. in a serious way, it's been a scary commute. a lot of crashes, tara. >> quite a few fender-benders this morning. they've been scattered all over the south bay, hayward, oakland and now san francisco. if we take a look at the maps,

8:56. the search resumes in the gold country for a missing miner from san jose. 65-year-old walter severt disappeared a week ago. rescuers are concerned because of rug -- because of the rugged terrain. they've been looking for him in nevada city in the south yuba river at the end of owl creek road. they found his car on monday. but no other signs of him.
